How long do I have to file a claim in Louisiana?

For most personal injury accidents occurring on or after July 1, 2024, Louisiana gives you two years from the date of the injury to file suit under La. C.C. art. 3493.1. Accidents that happened before July 1, 2024 are still governed by the old one-year rule. Wrongful death actions now prescribe one year from the date of death or two years from the day the injury was sustained, whichever is longer (La. C.C. art. 2315.2, as amended effective Aug. 1, 2025). Deadlines for some claims — including maritime, Jones Act, medical malpractice, and claims against government entities — are different. Do not guess: call us and we will confirm your deadline.

What should I do right after an accident?

Get medical attention first. Then document everything — photos of the scene, contact info for witnesses, and a copy of any police or incident report. Do not give a recorded statement to any insurance company before speaking with an attorney.
