How long do I have to file a personal injury claim in Louisiana?

For most Louisiana personal injury claims arising on or after July 1, 2024, you generally have two years from the date of injury to file a lawsuit. This was extended from one year under Act 423 of 2024 (Louisiana Civil Code Article 3493.1). Injuries that occurred before July 1, 2024 are still governed by the old one-year prescriptive period. Some claims — including medical malpractice, product liability, and wrongful death — follow different rules. Time still matters: evidence disappears, witnesses move, and adjusters work quickly. The sooner you call, the more options you have.

What if I am partly at fault?
